These Terms of Use constitute a legally binding electronic agreement between you (including any company you represent or that registered you, collectively referred to as "you") and www.bulgaro.io, including its owner and affiliates ("we", "us", "our", or "Bulgaro"). These terms govern your access to and use of our website, associated applications, and other services provided through the site (collectively, the "Services").

This agreement complies with applicable laws governing online and electronic contracts. It does not require a physical signature and is fully enforceable as an electronic contract.

By using any Bulgaro Services or registering on our website, you agree to be bound by these terms. If you do not agree with all the terms, please do not use our Services.

Your use of the Services is conditional upon your acceptance of these terms alone. If these terms are considered an offer, your acceptance is strictly limited to them, excluding any other terms.

Dispute Resolution

Where the law applicable to you permits it, any disputes arising under these terms will be resolved through binding arbitration, with limited exceptions, and by agreeing to these terms you waive the right to participate in class action lawsuits.

This arbitration agreement and class action waiver do not apply to you if you are a consumer resident in the United Kingdom, the European Economic Area, or any other jurisdiction whose law does not permit them. If you are such a consumer, nothing in these Terms prevents you from bringing proceedings in the courts of your country of residence, and your statutory rights are unaffected.

Before beginning any formal proceedings, we ask that you contact us at contact@bulgaro.io so that we can try to resolve the matter directly.

Additional Agreements

Your use of the Services is also subject to our Privacy Policy, which is incorporated by reference into these Terms. The Privacy Policy outlines how we collect, use, and protect your personal information.

Electronic Notices

By using our Services or communicating with Bulgaro, you consent to receive electronic communications from us regarding security, privacy, and administrative matters related to your use of the Services or these Terms.

In the event of a security breach, we may notify you electronically — either through a notice on the website or by sending an email to the address associated with your account.

General

Our Services are designed to help users ("Students") learn Bulgarian through a structured, step-by-step course created by Bulgaro. This includes the publication of a Bulgarian language course ("the Course"), supporting learning materials, and access to a discussion space for users.

We may update these Terms occasionally to clarify our policies or reflect changes to our Services, such as new features. Bulgaro reserves the right to modify these Terms at any time, at our sole discretion. If we make any material changes, we will notify you by a prominent method — such as an email to your registered address or a notice on the website.

Unless stated otherwise, updates to the Terms become effective on the date they are posted. Continued use of our Services after changes take effect indicates your acceptance of the revised Terms. We encourage you to check back regularly to stay informed of any updates.

We may modify or discontinue any part of the Services at any time without notice, except that any discontinuation affecting Lifetime Access is governed by the "Lifetime Access" section below.

You are responsible for any service charges, data fees, or equipment costs incurred while accessing the Services. This includes maintaining the necessary internet connection, hardware, and software.

If you choose to use any paid features of the Services, you agree to pay the applicable fees and any associated taxes. By providing a payment method, you confirm that you are authorized to use it and authorize Bulgaro to charge it for the relevant fees as they become due.

All use of the Services must comply with applicable laws and regulations, including those related to copyright, intellectual property, data protection, and privacy.

Conduct

You may only use the Services for lawful purposes. You are solely responsible for understanding and complying with all applicable laws, regulations, and rules related to your use of the Services.

As a Student, you represent, warrant, and agree that:

• You are at least 18 years old. If you are under 18, you will only use the Services with the supervision and approval of a parent or legal guardian. Children under 13 are not permitted to create an account or enroll in the Course.

• You have read, understood, and agreed to the pricing information provided on the website before enrolling in the Course or using any of the paid Services.

• You will not impersonate another individual or gain unauthorized access to another user's account.

• You will not upload, post, or transmit any unauthorized or unsolicited promotional materials, advertisements, spam, junk mail, chain letters, pyramid schemes, or any other form of solicitation, whether commercial or otherwise.

• You will not post or share content that is inappropriate, offensive, discriminatory, hateful, sexually explicit, false, misleading, infringing, defamatory, or unrelated to language learning.

• You will not copy, modify, reverse engineer, reproduce, distribute, publicly display or perform, create derivative works from, or otherwise exploit any part of the Services, the Course, Bulgaro Content, or user-submitted content. This includes any form of tampering, interference, or unauthorized access.

• You will not frame, embed, or otherwise attempt to circumvent the Services' intended use or access controls.

• You will not introduce any malicious code, including viruses, worms, spyware, or other programs intended to disrupt or damage the Services, hardware, software, or telecommunications systems.

• You will not use scraping tools, robots, spiders, or any other automated methods to access learning materials from the Services. You will also not use any method, whether automated or manual, to collect or harvest our content or learning materials.

• You will not share your personal information with instructors or other Students and will take appropriate steps to safeguard any personal information you disclose.

• You will not solicit personal information from instructors or other Students.

Registration

To access certain Services, you must create an account. During registration, you agree to provide accurate, complete, and up-to-date information, including your real name and a valid email address capable of receiving communications. This ensures we can deliver content, customer support, and network management services effectively.

You are solely responsible for keeping your account credentials confidential and for all activities that occur under your account. You represent and warrant that your account information will remain accurate at all times. If you become aware of any unauthorized access or security breach related to your account, you must notify us immediately. Additionally, you should log out after each session to protect your account.

To the extent permitted by law, we are not liable for any loss or damage resulting from your failure to fulfill these responsibilities or from any unauthorized use of your account before you notify us of a security breach.

Content, Licenses & Permissions

All software, technology, designs, materials, information, communications, text, graphics, links, electronic art, animations, illustrations, artwork, audio clips, video clips, photos, images, reviews, ideas, and any other copyrightable materials or content — collectively referred to as "Content" — are protected by intellectual property laws. "Bulgaro Content" refers to any Content provided by Bulgaro in connection with the Services, including, but not limited to, the software, products, and the website.

Content uploaded, transmitted, or posted to the Services by a user is referred to as "Submitted Content". The person or entity supplying the Content, or their affiliated third-party providers, retain ownership of the Content. Such Content is protected under copyright and other intellectual property laws in the United Kingdom and internationally.

You represent and warrant that you have the necessary licenses, rights, consents, and permissions to grant Bulgaro the rights described in these Terms regarding your Submitted Content. Furthermore, you confirm that Bulgaro will not need to obtain any additional licenses, rights, consents, or permissions from any third party for the use or exploitation of your Submitted Content as authorized under these Terms. Bulgaro will not be liable to you or any third party as a result of the use or exploitation of your Submitted Content.

Despite your ownership of Submitted Content, Bulgaro reserves the right, at its sole discretion and without prior notice, to remove, edit, or modify any Submitted Content for any reason, including but not limited to content that violates these Terms, is deemed inappropriate, or is otherwise objectionable.

Bulgaro grants you a limited, non-exclusive, non-transferable license to access and use both Submitted Content and Bulgaro Content for personal, non-commercial, educational purposes, provided you have paid all applicable fees. This license is granted solely for your use through the Services and in accordance with these Terms. Any other use, including reproduction, redistribution, modification, or sale, is strictly prohibited unless explicitly authorized in writing by Bulgaro.

Please note that Submitted Content and Bulgaro Content are licensed to you, not sold.

Bulgaro may revoke the license granted to you to access and use Submitted Content and Bulgaro Content where you are in breach of these Terms, where we are required to do so by law, or where we discontinue the Services in accordance with these Terms. Revocation of Lifetime Access is governed by the "Lifetime Access" section below.

Bulgaro respects copyright, privacy, defamation, and other laws governing content and information, and does not tolerate violations. However, Bulgaro does not screen Submitted Content, and any use of Submitted Content is at your own risk. Bulgaro is not liable for any use of Submitted Content, and the appearance of such content on the Services should not be interpreted as an endorsement or guarantee that the content complies with laws or meets a particular standard of accuracy or usefulness.

All rights not expressly granted in these Terms are reserved by the content owners. No implied licenses are granted under these Terms.

Trademarks

The trademarks, service marks, and logos (collectively, "Trademarks") displayed through our Services or in any Bulgaro Content are either registered or unregistered trademarks owned by us, our suppliers, or third parties. These Trademarks are protected by trademark laws in the United Kingdom and internationally. All rights are reserved. You may not alter, obscure, or link to any Trademarks without our prior written approval.

Pricing, Payment & Taxes

Pricing

The pricing for the Course is determined based on the price listed on the website, which may change at Bulgaro's sole discretion. As a Student, you agree to pay the fees for the Course in advance. Course access is offered on several plans: monthly and annual subscriptions, which renew automatically until you cancel them; fixed-length plans, which run for a stated period and do not renew; and Lifetime Access, which is a single payment and does not renew. For monthly and annual subscriptions, the payment method you have registered will be charged before the start of each new billing period. If Bulgaro decides to change the price of your active subscription, you will be notified at least 30 days in advance via the email address you provided during registration.

Payment

You can pay for the Bulgaro Course using the following payment methods: credit card, debit card, or iDEAL. Once you register a payment method on the website, Bulgaro is authorized to automatically deduct the subscription fee for each subsequent billing period without requiring additional authorization from you. No recurring charge is taken for fixed-length plans or for Lifetime Access. To cancel your subscription, you must follow the cancellation procedure on the website or send an email request to contact@bulgaro.io.

Lifetime Access

"Lifetime Access" is a one-off purchase. It does not renew and you will not be billed for it again. "Lifetime" refers to the lifetime of the Course and the Services, not to your own lifetime, and not to the lifetime of any particular feature, lesson, or format.

Lifetime Access grants you the licence described in these Terms for as long as we continue to make the Course generally available, subject to the following commitments:

• We will keep the Course available to holders of Lifetime Access for a minimum of three (3) years from the date of purchase.

• If we discontinue the Course, or withdraw Lifetime Access as a form of access, we will give you at least ninety (90) days' notice by email to your registered address.

• If we discontinue the Course within three (3) years of your purchase, we will refund the unused portion of your payment, calculated on a straight-line basis over thirty-six (36) months from the date of purchase.

Lifetime Access includes the corrections, maintenance, and updates we make to the Course during that period. It does not entitle you to a separate product, course, or language that we may publish in future, or to any feature that we market and sell separately.

Lifetime Access is personal to you. It may not be sold, transferred, shared, or assigned to another person.

Lifetime Access may be revoked without refund only where you breach these Terms, on the same basis as any other form of access.

Lifetime Access is covered by the 30-day money-back guarantee described below. That guarantee is in addition to, and does not limit, any statutory right of withdrawal or cancellation you have as a consumer.

Refunds

Bulgaro offers a 30-day, no-questions-asked money-back guarantee for subscriptions and for Lifetime Access purchased on the Bulgaro website. Each user is entitled to 1 refund only. If you request a refund, access to the Course will be immediately revoked. No refunds will be provided after the 30-day period, except where these Terms or applicable law provide otherwise.

Warranty Disclaimer

The Services, the Course, and any other materials made available through the Services are provided "as is" and without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Bulgaro and its affiliates, licensors, suppliers, advertisers, sponsors, and agents disclaim all warranties, including but not limited to implied warranties of title, non-infringement, accuracy, merchantability, fitness for a particular purpose, and any warranties arising from course of dealing, course of performance, or usage of trade.

Bulgaro and its affiliates, licensors, suppliers, advertisers, sponsors, and agents do not warrant that your use of the Services will be uninterrupted, error-free, or secure, that defects will be corrected, or that the Services, the submissions, the servers hosting the Services, or any third-party services are free of viruses or other harmful components.

No opinion, advice, or statement by Bulgaro or its affiliates, licensors, suppliers, advertisers, sponsors, agents, members, or visitors, made through the Services or otherwise, shall create any warranty. Your use of the Services, including any third-party services, is entirely at your own risk.

Limitation of Liability

Neither Bulgaro nor any of our subsidiaries, affiliates, licensors, suppliers, advertisers, sponsors, owners, directors, officers, employees, consultants, agents, or other representatives are liable for any indirect, incidental, consequential, special, exemplary, punitive, or other damages (including, without limitation, loss of business, data, or profits) arising from or related to the Services, materials, third-party platforms, submissions, linked websites, or any products or services purchased or accessed through the Services or any third-party platform, whether based on contract, negligence, strict liability, or any other legal theory.

Your sole remedy for dissatisfaction with the Services, materials, third-party products or services, submissions, or linked websites is to stop using them.

The maximum liability of Bulgaro for any damages, losses, or causes of action, whether in contract, tort (including negligence), or otherwise, shall not exceed the greater of (a) the total amount paid by you to Bulgaro in the 12 months preceding the event giving rise to the claim, for access to or use of the Services, and (b) where you hold Lifetime Access, the amount you paid for that Lifetime Access.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law applicable to you. If you are a consumer, your statutory rights — including any right to a remedy where the Services are not as described, not of satisfactory quality, or not fit for a purpose you made known to us — are not affected by these Terms, and the warranty disclaimer above applies only to the extent permitted by law.

Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. Communications between you and Bulgaro or its representatives do not waive any limitations of liability or create any additional warranties not explicitly stated in these Terms. Multiple claims will not increase the damage limit stated herein.

You agree that the damage exclusions in these Terms apply even if a remedy fails of its essential purpose.

Indemnification

You agree to indemnify, defend, and hold harmless Bulgaro, its affiliates, officers, directors, agents, partners, employees, licensors, representatives, and third-party providers from and against any reasonably foreseeable losses, expenses, damages, costs, claims, and demands, including reasonable attorneys' fees, arising from or related to your breach of any representation or warranty in these Terms.

We reserve the right, at our own expense, to assume exclusive control of the defense of any matter subject to indemnification by you. You agree to cooperate fully with us in the defense of such matters and in asserting any available defenses.

Termination

Bulgaro reserves the right, at its sole discretion, to terminate, suspend, modify, or delete (a) any Content, parts of the Courses, or Services, and (b) your access to the Services or your account, as follows:

• If you breach any of these Terms or our applicable policies, Bulgaro may take action immediately without prior notice. In such cases, we are not liable for any loss of access to the Course you purchased or any other Services associated with your account. For the avoidance of doubt, you will not be entitled to compensation or a refund for any lost access to the Services, including the Course you purchased.

• We may also take action for any reason or no reason. In this case, we will notify you in advance. If we terminate your access, and you are a Student, we will refund you for any lost access to the Course you purchased within the one (1) month period prior to termination, in accordance with our refund policy. Where you hold Lifetime Access, we will instead refund you in accordance with the "Lifetime Access" section above.

You may terminate your subscription at any time by using the provided functionality on the website or by emailing contact@bulgaro.io. Upon termination, you will retain access to the Course until the end of the period for which the subscription fee has been paid. Lifetime Access does not renew and so does not need to be cancelled; if you ask us to close your account, your Lifetime Access ends with it and is not refundable except as set out above. We are not obligated to retain your account or Submitted Content beyond any period required by applicable law. Any accrued payment rights and all representations and warranties will survive termination.

Miscellaneous

Entire Agreement

These Terms, along with any applicable policies posted on our Services, constitute the entire agreement between the parties regarding the subject matter hereof and supersede all prior written or oral agreements related to such subject matter.

Severability

If any provision of these Terms is deemed illegal, void, or unenforceable, it will be severed from these Terms without affecting the validity or enforceability of the remaining provisions.

Waiver

Any waiver of a provision of these Terms must be in writing and executed by the party entitled to benefit from the provision. The failure of Bulgaro to exercise or enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

Notice

All notices or communications under these Terms must be in writing and sent via email to the address registered with your account. This includes, but is not limited to, legal notices, administrative updates, security alerts, termination notices, and payment-related communications. It is your responsibility to ensure your registered email address is accurate and up-to-date.

No Agency

These Terms do not create any partnership, joint venture, agency, employer-employee, or contractor relationship between the parties. Neither Bulgaro nor any other party has the authority to make binding commitments or take any action on behalf of the other unless explicitly authorized in writing.

Governing Law

These Terms, and your use of the Services, will be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. If you are a consumer, this choice of law does not deprive you of the protection afforded by any mandatory provisions of the law of the country in which you are resident, and you may bring proceedings in the courts of that country.
